Hi, rider! Below we present our Terms & Conditions for renting electric bikes with us.

Please read the definitions of key term first, and then, click on "+" next to each section of the Terms & Conditions and it will expand the content of each section.

Remember to read the entire content of current Terms & Conditions before accepting our services.
Definitions
The capitalized terms used in the Regulations have the following meaning:

Subscription: a rental agreement concluded between Move and the Customer, the subject of which is the rental of a Bike by the Customer, the provisions of which are expressed in these Regulations;

Bike: electric bike made available to the Customer by Move as part of the Subscription;

Client: any natural person who is at least 18 years of age and has full legal capacity who has purchased a Subscription via Move;

Move: Move limited liability company with its registered office in Warsaw (00-503), at ul. Żurawia 6/12, office 766, entered into the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under the number: 0000808618, with NIP: 7010949778;

Terms & Conditions: this document specifying the use of services provided by Move, the provisions of which constitute the Subscription conditions;

Website: https://mymove.pl through which Move provides its services, including the Subscription;

End date: the day on which the Subscription ends by cancellation by the Customer as explained in point 4 of the Regulations;

Promo code: an electronic voucher with a value specified by Move and an expiry date that may be used by the Customer to pay for the Subscription. After the expiry date, the Discount Code is considered expired and will not be honored by Move;

Fault: random defect resulting from normal use of the Bike, in particular a punctured inner tube, broken chain, broken gear hanger, damaged derailleur, broken spoke, damaged cassettes, damaged brakes;

Damage: defect of the Bike caused by improper use of the Bike or resulting from a random event, in particular in the form of broken or bent parts of the Bike.
1. Conclusion of the contract
1.1. The contract may be concluded only by a natural person:
- who is at least 18 years old;
- has full legal capacity.

1.2. The condition for the conclusion of the Agreement by the Customer is to fill in the subscription form on the Website and accept current Terms & Conditions.

1.3. Filling out the form on the Website is done by:
1.3.1. Filling in the subscription form available on the Website, in which the following personal data must be provided:
- name and surname;
- address;
- PESEL;
- ID type;
- ID number;
- phone number;
- e-mail address.
1.3.2. Expressing consent to the processing of the Customer's personal data by Move,
1.3.3. Accepting current Terms & Conditions,
1.3.4. Providing payment card details and issuing a direct debit in order to make payments for the Subscription or using the rebate code, as specified in point 8.1 of the Regulations.

1.4. The condition for concluding the Subscription is the provision of real data by the Customer.

1.5. Move reserves the right to verify the data provided by the Client, used for registration at the time of handing over the bike.

1.6. The subscription is concluded with the acceptance of the Regulations for the duration referred to in point. 4.2 of the Regulations.

1.7. Move declares that all services provided on the basis of the Regulations do not violate generally applicable law and the rights of third parties.

1.8. In order to confirm the conclusion of the Subscription, to the Customer's e-mail address provided in the form referred to in point 1.3.1.6. Of the Regulations, confirmation is sent along with the Regulations in the wording on the date of the Subscription.
2. General Terms of Subscription
2.1. Customer obtains rights from the Subscription upon accepting the Regulations. In order to purchase a subscription, the Customer should have:
- a device with access to the Internet;
- a web browser that supports JavaScript;
- enabled cookies;
- active e-mail account (e-mail address).

2.2. The Client will have the Electric Bike at his disposal for the duration of the Subscription.

2.3. The Bike is equipped with a battery with one key and a rear wheel lock with a chain with one key. The customer may have only one copy of the key to lock the battery and lock the rear wheel at a time. If the key is lost or damaged, the Customer should report this fact to Move and obtain a new key from Move, the cost of which is PLN 50. A key that was previously reported as lost and that has been recovered must be returned to Move immediately.

2.4. As part of the Subscription, the Customer has the right to a free Replacement (detailed information can be found in point 7 of the Regulations).

2.5. The Bike may contain advertisements. The Customer must immediately contact Move if the advertisement has been damaged or the advertisement has completely disappeared from the Bike.

2.6. Move will always be entitled to transfer claims against the Client, against third parties.

2.7. Move issues promo codes, which may be offered by entities cooperating with it.
3. Terms of the Bike use
3.1. Client undertakes to use the Bike in accordance with the law, in accordance with its intended use and with due diligence, taking care of in order not to damage or destroy it.

3.2. The bike is intended only for the personal use of the Client.

3.3. During the night hours, i.e. from 22.00 to 6.00, the bike should be kept in the premises, house, flat, basement, garage, pram or in other closed rooms.

3.4. Leaving the Bike on the street or in other publicly accessible places, the Bike should be secured by blocking the rear wheel and fixing the frame of the Bike with the attached chain. The frame must be attached to a bicycle rack or other fixed, stationary object. You should also secure the battery by setting the closed position.

3.5. The Bike will remain the property of Move at all times. The Client may not transfer the Bike to third parties, in particular for use, rental or lease to third parties, as well as provide any security on the Bike.

3.6. The customer will be responsible for communicating changes to the known Move data such as the new address immediately, no later than 14 days from the date of data change.

3.7. The Client may not make any changes to the Bike, which cannot be removed without damaging the Bike and may not manipulate the Bike's electronics and / or software in any way.

3.8. After covering the distance of 250 km and 2,500 km by Bike, Move will contact the Client in order to arrange the inspection of the Bike.
4. The duration of Subscription and it's cancellation
4.1. The duration of the Subscription is determined in the process of ordering and starts to run from the date of Bike receipt by the customer.

4.2. In the case of:

4.2.1. Monthly Subscription, after one full month (30 days) of Subscription, the Customer may terminate it at any time with one month's notice.
4.2.2. Weekly Subscription, after one week (7 days) Subscription, the Customer may terminate it at any time with one week notice period.

4.3. The Client can cancel the subscription by sending a statement to address kontakt@mymove.pl. From the date on which the cancellation of the Subscription by the Customer was received by the Move, the Subscription will last for a further 7 or 30 days, depending on the type of Subscription concluded ('End Date').

4.4. The Client has the right to use the Bike until the Subscription End Date after submitting the notice. Customer is responsible for paying the cost of Subscription until the End Date. In this case, the payment for the week/ month in which the Subscription ends will be proportionally reduced to the days from the beginning of the month to the End Date.

4.5. The Client may change the Subscription from monthly to weekly or from weekly to monthly at no additional cost.

4.6. The bike and the key must be delivered to the Move's office no later than on the End Day.

4.7. Handing over the Bike by the Client before the End Date shall result in the expiry of all rights of the Client under the Subscription, without prejudice to the Client's obligation to cover the full costs of the Subscription until the End Date.

4.8. The Client may cancel the subscription termination free of charge by sending an e-mail to Move to the following address: kontakt@mymove.pl at the latest on the day preceding the end date.

4.9. If the Bike is not returned on or before the End Day, Move reserves the right to impose a contractual penalty in the amount of PLN 100 for each day of delay in the return of the Bike, maximum 7 days.

4.10. If the Bike is not returned to the Move within seven days from the End Date, ai The subscription will not be reactivated, Move may charge the Customer with the total cost of the Bike, which is PLN 5,900.

4.11.The Client will be obliged, at the request of Move, to return the Bike on the terms and at the time specified by Move each time. On the day of returning the bike, the parties will terminate the Subscription and Move will reimburse the Client for the Subscription costs for the period from the day following the return to the end of the purchased Subscription.
5. Faults and damages
5.1. The Client is obliged to report the Move any faults and / or damages to a Bike within 3 working days of their discovery. Failure to report faults or Uharm within a predetermined period may result in the responsibility of the customer to the resulting faults or damages.

5.2. In order to repair faults and / or Damages to the Bike, the Client undertakes to deliver the Bike to the Move service to the address Dzielna 78.

5.3. Move reserves the right to check the condition of the Bike. Upon request of Move, the Client will cooperate with any necessary services or maintenance.

5.4. In the event of any faults and / or damages and wear of the Bike other than those resulting from normal use, Move reserves the right to claim compensation from the Client.

5.5. Move is not responsible for any damage or harm suffered by the Client as a result of using the Bike, except in the case of intentional action or gross negligence on the part of Move.
6. Bike Loss / Serious damage / Theft
6.1. If the Client parks a Bike, it must always be secured in the manner specified in point 3.4. Of the Terms & Conditions.

6.2. In the case of Bike Loss / Serious damage / Theft and / or battery, the Customer will be required immediately report this Move within 24 hours, provide the Move with the key to the Bike, and cover the damage to Move due to the loss of the Bike in the amount of PLN 5,900 (five thousand nine hundred zlotys 00/100) within 7 days from the event occurrence.

6.3. For everyone the day of delay in reporting the loss of the Bike, Move may require the Client to pay a contract penalty in the amount of PLN 100 (one hundred zlotys 00/100).

6.4. If the customer fails to report the loss or delay Bike indicated in paragraph 6.2. above within 14 days, Move may request from the Client, regardless of the payment of contractual penalty referred to in point. 6.3. above, a payment of a contractual penalty corresponding to the value of the lost Bike and the lock in new condition.

6.5. If the Bike is found and the Client is late with reporting the loss of the Bike for at least 14 days, Move will not charge the Client with a penalty, the agreement indicated in point 6.4, but may require the Client to pay a contractual penalty in the amount of PLN 1,500 (one thousand five hundred zlotys 00/100) for each day from the date of reporting the loss to the date of finding the Bike.
7. Bike Replacement
7.1. Bike replacement can only take place in case of a serious Bike fault, serious Bike damage due to road accident, or loss of a Bike.

7.2. At the reasoned request by the Client, Move will replace the Bike within 2 working days, but no later than within 7 working days after being contacted by the Client.The Client will receive another Bike with a battery, a wheel lock and a key.

7.3. If the Bike replacement timeframes are not reached, the Client cannot claim any compensation or payment.

7.4. Along with the placement of the Bike, the Client will hand over the damaged Bike to Move along with the battery, blockade and key.
8. Payment
8.1. By concluding a Subscription, the Customer will also be required to make a direct debit to the Move bank account number of the monthly Subscription costs and other costs due. Payments will be made via thesystem Stripe, the terms of which are available at the following address: www.stripe.com/en-gb-pl/privacy.

8.2. The fee is determined in accordance with the currently applicable price list indicated in point 8.4 of the Terms & Conditions and is payable weekly or monthly in advance via the Stripe system referred to in point. 8.1 of the Terms & Conditions.

8.3. Renewal for the next billing period is valid for active and paid Subscriptions for which the funds covering the cost of renewing the Subscription for the next billing period have been successfully collected from the payment card connected to the System by the Customer.

8.4. The Subscription fee is:
- PLN 125 gross per week (7 days) n the case of a weekly Subscription;
- PLN 450 gross per month (30 days) in the case of a monthly Subscription.

8.5. For each day of delay in paying the Move Subscription fee, Move will be entitled to statutory interest from the Client for the delay, which will be added to the fee for the next billing period.

8.6. Payment for a Subscription may also be made in part or in full with the use of a Discount Code. For this purpose, the Customer, when placing the order, is obliged to provide the number of the Discount Code.
9. Responsibility
9.1. The collection and return of the Bike will be made on the basis of the handover protocol.

9.2. If the Client has doubts as to the safety of the Bike, he must immediately contact Move via e-mail.

9.3. The Client uses the bike at his own risk. The Bike (RadMission 1) manual is available on the following website:

10. Changes to the Terms & Conditions
10.1. Move reserves the right to Subscription cost changes. The changes will be sent to the Customer by e-mail at least one month before the effective date of the new Subscription amount. In this case, the Customer will have the right to withdraw from the Agreement within 30 days from the date of receipt of information about the change in the Subscription amount.

10.2. Changes to the Terms & Conditions will be provided at least one month before their entry into force in the form of an announcement on the website www.mymove.pl and an e-mail to the Client.
11. Failure to fulfill the obligations
11.1. Move will be entitled to terminate the Subscription with immediate effect, in whole or in part, or to cancel the Subscription upon written notification to the Customer, if:
- Customer fails to fulfill its obligations under the Subscription, and in particular fails to pay the required fees for at least two consecutive periods billing;
- The Client uses the Bike contrary to the provisions of the Regulations, and in particular causes its destruction or damage;
- The Customer intentionally provides Move with false information.

11.2. In the cases referred to in paragraph 11.1 above, Move, immediately after the termination of the Subscription, will call the Customer to return the Bike and pay the fee for the period counted from the date of termination of the Subscription to the End Date within 7 days from the date of receipt of the request. If the returned Bike shows traces of damage that are not a consequence of the normal use of the Bike, Move reserves the right to charge the Client with the costs of repairing the Bike.

11.3. The Customer has the right to immediately terminate the Subscription if Move has repeatedly and / or seriously failed to fulfill its obligations described in the Terms & Conditions.

11.4. In the case indicated in point 11.3 of current Terms & Conditions, Move immediately after the termination of the Subscription will call the Client to return a bike and pay a fee for the last accounting period within 7 days of receipt of the request. As a result of the termination of the Subscription on the terms set out in this point. 11.3 of the Regulations, Move will not charge the Customer with any additional costs. If the returned Bike shows traces of damage that are not a consequence of the normal use of theBike, Move reserves the right to charge the Client with the costs of repairing the Bike.

11.5. The sum of contractual penalties, which may occur Move from the Customer hereunder shall not exceed 10.000,00 zł (ten thousand 00/100) in the year in which you have concluded subscription for at least one (1)week.

11.6. Payment of contractual penalties specified in the Regulations does not preclude Move from pursuing claims on general terms that exceed the amount of the contractual penalty.
12. Personal data
12.1. The administrator of the Customers' personal data is Move, hereinafter also referred to as the "Administrator".

12.2. With the acceptance of the Regulations, the Customer agrees to the processing of personal data for the purpose of concluding and implementing the Subscription on the terms set out in these Regulations. Before accepting the Regulations, its content, including in particular the provisions of this section 11.

12.3. The administrator processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general regulation on the protection of personal data; GDPR).

12.4. Persons whose personal data is processed by the Administrator have the right, in particular to:
- access their data and receive a copy of it;
- rectify (correct) their data if it is incorrect or out of date, and the right to delete it if the data is not processed. in order to fulfil an obligation resulting from a legal provision or in the exercise of public authority;
- limit or object to data processing;
- lodging a complaint to the President of the Personal Data Protection Office (to the address of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).

12.5. Personal data will not be profiled and decisions will not be made in an automated manner.

12.6. The recipients of Customers' personal data may be entities supporting Move in performing the Subscription, in particular the entity dealing with the bicycle service, persons providing legal, accounting, insurance and IT services to Move, as well as payment operators, auditors and entities authorised to receive the Customer's personal data. on the basis of legal provisions (e.g. courts, state administration bodies). Personal data of Customers who will pay for the Subscription in the manner specified in point 8.1 may be made available to payment service providers based in San Francisco, California, United States.

12.7. In all matters related to the processing of personal data of customers, especially in the case of exercising the rights in point 12.4 above, please contact the Administrator via the following e-mail address: kontakt@mymove.pl.
13. Complaints and Disputes
13.1. When using the Subscription, all complaints regarding the Subscription should be directed by correspondence or e-mail to the addresses indicated in point 15.1.1. or 15.1.2. Of the Terms & Conditions.

13.2. The complaint should include: name, surname and exact address of the customer, as well as a detailed description and reason for the complaint. Move reserves the right to leave the complaint without consideration if it does not meet the requirements indicated in the previous sentence.

13.3. Complaints will be considered within 14 days from the date of their receipt by Move. In the event of a complaint with a complicated factual state, Move reserves the right to extend the complaint time to 60 days from the date of its receipt by Move, about which the Customer will be informed within the time limit indicated in the previous sentence.

13.4. Complaints will be considered on the basis of these Regulations.

13.4. Any disputes arising from the Subscription or related to it, the Parties undertake to resolve amicably. In the event that the Parties do not reach a consensus within 30 days from the date on which the Party claiming the claim presents it to the other Party, the dispute shall be submitted to the court having jurisdiction over the seat of Move.

15. Withdrawal from Subscription
15.1. The Client has the right to withdraw from the Subscription without giving reasons within 3 days from its conclusion. For this purpose, he should send to Move, to the e-mail address: kontakt@mymove.pl, the completed and signed declaration, the specimen of which is attached as Appendix 2, and return the Bike within 3 days to Move.

15.2. If the returned Bike shows traces of damage that are not a consequence of the normal use of the Bike, Move reserves the right to charge the Client with the costs of repairing the Bike.
